These Terms of Use ("Terms") govern your access to and use of the Stress Platform (the "Platform") operated by ZenFuture LTD ("we", "us", or "our"). By using the Platform, you agree to be bound by these Terms.

1. Authorization and Access

The Platform uses Apple ID for login. You agree to use the Platform solely for personal, non-commercial purposes and in accordance with these Terms.

2. Artificial Intelligence and Recommendations

The Platform uses artificial intelligence technologies (including solutions from OpenAI) to generate personalized recommendations and insights based on your health data. You understand and agree that:

• the recommendations are generated by AI algorithms and are for informational and educational purposes only;
• they do not constitute medical, health, or professional advice;
• they may contain errors, inaccuracies, or be incomplete;
• AI technology has inherent limitations and may produce unexpected or incorrect results.

DO NOT rely on the Platform's recommendations as a substitute for professional medical consultation, diagnosis, or treatment.

3. Medical Disclaimer and Health Information

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

THE STRESS PLATFORM IS NOT MEDICAL SOFTWARE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION.

Not Medical Advice

All information, content, and recommendations provided by the Platform, including but not limited to stress levels, recovery metrics, health insights, and AI-generated suggestions, are for informational and educational purposes only. They do not constitute medical advice and should not be relied upon as such.

Consult Healthcare Professionals

You should always consult with a qualified healthcare professional before:

• making any decisions regarding your health;
• starting, stopping, or modifying any treatment or medication;
• changing your diet, exercise routine, or lifestyle;
• interpreting any health data or recommendations from the Platform.

Never disregard professional medical advice or delay seeking it because of information you received from the Platform.

Not for Emergencies

THE PLATFORM IS NOT INTENDED FOR USE IN MEDICAL EMERGENCIES. If you are experiencing a medical emergency, immediately call emergency services (999 in the UK, 911 in the US, or your local emergency number) or visit the nearest emergency department. Do not rely on the Platform for urgent medical situations.

Data Accuracy and Limitations

While we strive to provide accurate information, you acknowledge that:

• Health data collected from wearable devices may be inaccurate or incomplete;
• AI algorithms may produce errors or unexpected results;
• The Platform cannot account for all individual health factors, conditions, or circumstances;
• Recommendations are generalized and may not be appropriate for your specific situation.

Individual Responsibility

You are solely responsible for:

• evaluating the accuracy and appropriateness of any information or recommendations;
• your health decisions and actions taken based on Platform information;
• monitoring your own health and seeking professional medical care when needed.

ZenFuture LTD expressly disclaims any liability for health outcomes or decisions made based on Platform information.

4. Subscriptions and Payments

Some features of the Platform are available with a paid Premium subscription.

All payments are processed by a third-party provider (Stripe) in accordance with their Privacy Policy. We do not store or process any payment information.

Premium Subscription

Premium is an optional paid upgrade that gives you access to extra features.

Once you activate Premium, your monthly plan stays active and renews automatically each month until you cancel it. You can cancel your Premium plan anytime. After you cancel, your Premium access remains active until the end of your current billing period — so you can keep using all Premium features until then.

Refunds

We generally don't offer refunds, except if something went wrong — like a duplicate charge or a technical issue. If you think you subscribed to Premium by mistake, just reach out to us at help@stress-platform.com within 3 days of activation. We'll refund you in full and switch your account back to the Basic plan.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENFUTURE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Platform is provided "as is." We do not guarantee uninterrupted operation or the accuracy of any recommendations.

You agree to use the Platform at your own risk. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or £100 (one hundred pounds sterling), whichever is greater.

We are not liable for any losses, damages, or consequences including but not limited to:

• health outcomes or medical decisions made based on Platform information;
• inaccurate data, recommendations, or AI-generated content;
• service interruptions or technical failures;
• loss of data or unauthorized access to your account;
• consequences of decisions made based on Platform suggestions.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

6. Intellectual Property

All materials available on the Platform (including design, interface, content, and algorithms) are the property of ZenFuture LTD.

You may not:

• copy or distribute the Platform;
• modify or use it for commercial purposes;
• decompile, transmit, or license any of its components.

7. User Conduct and Acceptable Use

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, or impair the Platform. Prohibited activities include, but are not limited to:

• Harassment, threats, or abuse of other users or our staff;
• Attempting to gain unauthorized access to the Platform or its systems;
• Uploading or transmitting viruses, malware, or other malicious code;
• Engaging in any activity that interferes with or disrupts the Platform;
• Using the Platform for commercial purposes without our written consent;
• Violating any applicable laws or regulations.

8. Warranty Disclaimer

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• the Platform will be uninterrupted, secure, or error-free;
• the results obtained from use of the Platform will be accurate or reliable;
• any errors in the Platform will be corrected;
• the Platform will meet your specific requirements.

You acknowledge that your use of the Platform is at your sole risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless ZenFuture LTD, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your use or misuse of the Platform;
• your violation of these Terms;
• your violation of any rights of another party;
• your violation of any applicable laws or regulations.

10. Termination of Access

We reserve the right to suspend or terminate your access to the Platform without prior notice in the event of:

• violation of these Terms;
• suspicious, harmful, or inappropriate activity;
• prolonged inactivity;
• any reason at our sole discretion.

Upon termination, your right to use the Platform will immediately cease. Sections relating to Limitation of Liability, Indemnification, Warranty Disclaimer, and Governing Law shall survive any termination.

11. Age Restriction

The Platform is intended for users who are at least 13 years of age (or 16 years of age in the European Union). By using the Platform, you represent and warrant that you meet the applicable age requirement. If we discover that a user does not meet this requirement, we will terminate their account.

12. Third-Party Services

The Platform integrates with third-party services including but not limited to Apple ID (for authentication), Stripe (for payments), OpenAI (for AI recommendations), and AWS (for hosting). We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is subject to their respective terms and policies.

13. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at help@stress-platform.com.

15. Assignment

We may assign or transfer our rights and obligations under these Terms to any third party at our sole discretion, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZenFuture LTD regarding the use of the Platform and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

19. Updates to Terms

We may update these Terms of Use from time to time. The Effective Date at the top of this page indicates when these Terms were last revised. When we update these Terms, the updated version will take effect immediately. By continuing to sign in and use the Platform after any changes, you acknowledge that you have read and agree to the current version of these Terms.
